TERMS & CONDITIONS – FINAL CHECK-IN
Nature of the Service
Final Check-In is a digital communication and message-delivery service that allows users to securely store personal messages, memories, and files, and to have them delivered to selected recipients only if the user fails to complete a scheduled check-in.
This service is designed to reduce uncertainty and support personal communication.
It does not replace legal, governmental, or estate-planning processes.
Not a Legal Will or Estate Service
Final Check-In is not a legal will, testament, or estate-planning service.
• This platform does not create, replace, validate, interpret, execute, or store legally binding wills or estate documents.
• Messages and content delivered through this service are personal, informational, or emotional communications only.
• This service does not replace a lawyer, notary, or legally valid document in any country or jurisdiction.
• Final Check-In does not provide legal, financial, or estate-planning advice.
Users seeking legally valid wills or estate planning must consult a licensed lawyer or notary in their jurisdiction.
Uploaded Documents Disclaimer
Users may upload copies of documents (including but not limited to wills, insurance policies, or letters) for personal reference or private sharing only.
• Uploaded documents are stored and shared exactly as provided by the user.
• Final Check-In does not verify, validate, review, authenticate, or confirm the accuracy, legality, completeness, or current validity of any uploaded document.
• The authoritative version of any legal document remains with the issuing professional, institution, or original storage location.
When shared, documents may include the following notice:
“This document was uploaded by the user and shared according to their instructions. Final Check-In does not verify or validate its contents.”
Check-In & Message Delivery Process
Users receive a weekly check-in email to confirm they are active.
If no check-in is completed:
• A first reminder is sent after 24 hours
• A second alert is sent after an additional 24 hours
• If no check-in occurs after the full reminder cycle, the user’s message and selected files may be delivered to the designated recipient(s)
This delay exists to help protect against temporary situations such as illness, hospitalization, travel, or internet disruption.
Subscription & Service Suspension
An active subscription is required for message delivery.
If a subscription ends, expires, or is canceled:
• Message delivery is automatically paused
• No content will be sent to recipients
• Failure to complete check-ins may result in message delivery only while the subscription is active
Final Check-In is not responsible for delivery if a subscription is inactive at the time of a missed check-in.
User Responsibilities
Users agree that they:
• Are responsible for the accuracy and completeness of all information provided
• Will not include passwords, PINs, or highly sensitive access credentials in messages
• Understand that messages may be delivered exactly as written
• Are responsible for keeping recipient contact information up to date
Final Check-In is not responsible for consequences resulting from outdated, incorrect, or incomplete user information.
Data Storage & Security
• User data is stored on secure servers provided by our hosting partners
• Depending on infrastructure, data may be stored in Canada or the United States
• Uploaded files and messages are never shared except according to the user’s explicit instructions
While reasonable technical and organizational measures are taken to protect user data, absolute security cannot be guaranteed.
By using this service, users consent to data storage and processing in accordance with applicable privacy laws.
Global Use & Jurisdiction
Final Check-In is accessible worldwide.
Users acknowledge that:
• Laws regarding digital messages, wills, and estates vary by country
• This service makes no claim of legal validity in any jurisdiction
• Users are responsible for ensuring compliance with local laws
Limitation of Liability
Final Check-In shall not be liable for:
• The legal validity or enforceability of any content
• Actions taken by recipients based on delivered messages
• Missed deliveries due to incorrect user data, inactive subscriptions, or technical failures beyond reasonable control
